If you are intending to use Wills No Frills,

please note:

  • If you own businesses, have complex asset structures or complex family dynamics, Wills No Frills may not be suitable for you.
  • Wills No Frills does not provide legal advice. It creates simple Wills that are correctly worded. If you want legal advice, this product is not right for you. We take no liability if the Will fails to achieve your intentions due to your failure to obtain legal advice on your testamentary wishes.
  • If you require a complex Will (such as one including testamentary trusts, rights of occupation, or conditional gifts), Wills No Frills may not be the right choice. We instead invite you to make an appointment for a traditional Will.
  • If you purchase a simple Will from us and later decide that you need a more complex one, no refund will be given. However, we will apply a credit of $150 toward the cost of an appointment with a Solicitor at Jess Bourke Legal to obtain a more complex Will.
  • Superannuation and life insurance do not automatically form part of your estate. You should ensure that you have made binding death nominations with your funds that enables your super and life insurance to form part of your estate, if you want these assets to be dealt with in your Will. Also consider getting taxation advice on this issue.
  • If you own an asset with another person as joint tenants, then this asset will go to the surviving tenant if you die first - regardless of what is in your Will. It is therefore your responsibility to ensure that you know how you own assets or that you get legal advice before making a Will. We do not to title searches or provide advice on this when you use our Wills No Frills service. If you own an asset as joint tenants and don’t want the asset to pass to the surviving tenant - please get legal advice on severing tenancy or changing the asset structure, in addition to making a Will.
  • Wills No Frills Wills are checked by an Australian Solicitor before they are sent to you.
  • Once a draft Will is sent to you, you may request minor amendments or corrections of typos within six months of receiving it. Changes to instructions, major revisions, requests for advice or requests made after six months will require a new submission and full payment.
  • We note that we will action all submissions and enquiries for help as soon as possible. In peak times (such as when Jess or our solicitors are in Court), it may take us 7-10 business days If your matter is urgent and you need your Will urgently or need a question answered urgently - please call us at 0400 627 897 or email admin@jessbourkelegal.com.au after you have submitted the questionnaire and we will escalate your matter.
